Update – 28 July 2020: A Tunisian appeals court upheld the conviction of the two Tunisian men, but reduced their sentence to one year in prison. Their case could now go to the Court of Cassationfor the final appeal. It's time to to dial up the pressure.
---------------------
Two 26 years old Tunisian individuals were sentenced, by the Tribunal of First Instance in Kef, to two years in prison under Article 230, which criminalizes consensual homosexual conducts with up to three years in prison. The two young individuals were arrested by police last month, June 2020, on suspicion of homosexual conduct when one of them filed an unrelated complaint against the other. These latter have refused to undergo anal examination, a practice that is used as a "proof" of homosexual conduct in Tunusian courts.
This conviction, under the infamous article of the penal code, is a violation of fundamental rights protected by the new constitution and international conventions and treaties ratified by Tunisia such as the right to privacy and the right to non discrimination.
- Free, immediately, the two young individuals of el Kef sentenced to 2 years in prison.
- Abolish article 230 of the penal code, which criminalizes homosexuality with a sentence of up to 3 years in prison.
- Ban the practice of forced anal examination as an evidence of homosexual practices.
- Update and harmonize the penal code and the procedural penal code with the constitution of 2014.
- Respect the international commitments of Tunisia in matters of human rights.
