SUPPORT THE INCLUSION OF SAME-SEX MARRIAGE IN KOSOVO

CSOs in Kosovo consider the Draft-Civil Code violates the rights to partnership (marriage or civil unions) for LGBTI individuals in Kosovo

CSGD - NGO has worked for LGBTI rights in Kosovo, since Dec 2018. We have been engaged with the EU Project Team on drafting the Civil Code of Kosovo regarding the inclusion of same-sex marriage. In March 2019, clear recommendations with all legal clarifications and justifications were delivered to EU Team.

CSGD - NGO was firm in not favoring same-sex marriage or civil unions being regulated with a specific law. Based on up to date practices, non-conforming traditional issues that have been proposed to be regulated with the specific law have actually never been regulated in Kosovo.

The Minister of Justice, Mr. Selim Selimi at the press conference on July 7, 2020 stated that they have been able to preserve the "traditional nucleus" of marriage, thus favoring marriage between husband and wife and discriminating against other forms of marriage or civil unions.

CSOs will use all legal means and legal mechanisms to regulate all forms of marriage and civil unions without distinction in the Draft Civil Code.

To Mr. Selim Selimi - Minister of Ministry of Justice:

CSOs call upon the Ministry of Justice, Minister Selim Selimi to take into consideration the institute of the Constitution of Kosovo, art. 37 “Equality Before the Law” which guarantees the right to marriage and family for all citizen.

Hence, CSOs request to have all possible partnerships (marriage or civil unions) be regulated by the Civil Code.

Because the practice to regulate other forms of partnerships with special law tends to separate the right to partnership for LGBTI individuals from other citizens of Kosovo.
