Haiti: Protect the Rights and Health of LGBT+ People

The new Haitian Penal Code has removed the protections provided for in the preliminary draft. We demand their urgent reintroduction.

In Haiti, the draft of the new criminal code finally included protections against discrimination based on sexual orientation.

These articles would have made it possible to punish hate crimes and offer legal protection to LGBT+ people. But when the code was finally adopted, these provisions were simply removed. Today, the current criminal code no longer contains any reference to sexual orientation.

In criminal cases – including rape, murder, or serious violence – the victim's sexual orientation is not recognized as an aggravating circumstance. The Haitian government must reintroduce protections against discrimination and reiterate that human rights are non-negotiable.

We, the signatories of this petition, express our deep concern at the adoption of a criminal code that has removed the anti-discrimination provisions included in the preliminary draft.

This decision compromises the safety, health, and dignity of thousands of people. Without a legal framework, victims of assault or exclusion find themselves without protection. Without safe access to police, health, and justice services, they are left behind at a time when Haiti is experiencing a major humanitarian crisis.

We call on the Haitian authorities to take immediate action to:

● Reintroduce the anti-discrimination protections removed when the penal code was adopted;

● Guarantee safe and equal access to health, police, and justice services for all;

● Affirm that the dignity and safety of LGBT+ people are an integral part of universal human rights.

Haiti has the opportunity to send a clear message: that of a country that defends the dignity of all. We urge you to act without delay.
