Equal rights for all families in Baja California Sur

The state law still includes discriminatory language that prevents same-sex led families from being recognized as families.

The Civil Code of Baja California Sur does not explicitly recognize families headed by same-sex partners. Additionally, it persistently uses language oriented towards heterosexual couples.

This is something that must change!

For example, it refers to "father and mother" in articles 59, 66, 67, 68, 69, which correspond to the process for processing a birth certificate, thus excluding families formed by same-sex couples from its wording.

Not having this legal recognition for diverse families means that two dads or two moms cannot register their child as their own. Without a birth certificate, it is not possible to obtain health insurance or enroll the child in school – but above all, there is no way to prove that a mother or father has a bond with their child.

However, the Supreme Court of Justice of the Nation has already stated that "the concept of 'Family' is dynamic and responds to the structure and social model in which it develops, and therefore, the registration of their children should be independent of whether they are genetically descended or not." This ruling calls for the legislation of each state to be modified to accommodate all forms of family.

In 2022, an initiative was presented in the Local Congress of Baja California Sur proposing reforms to various provisions of the Civil Code, regarding the voluntary recognition of same-sex couples, so that mother-mother or father-father couples can register children with the Civil Registry in the state.

Unfortunately, this initiative was not approved, and discrimination continues.

Now we want to pressure the current legislature to approve bills that recognize and protect diverse families. We want to live in a society that has room for all forms of families.

Dear Deputies of the XVII Legislature of the H Congress of the State of Baja California Sur, our families, both homoparental and lesbian-maternal, live daily in defenselessness and discrimination, as even though we are already established families, we are not recognized by the Civil Registry. This is why it's important to reform the articles that do not grant us equal rights in our state!
